  • Situation
    A major owner of commercial real estate, with a portfolio of 70 + million SF, hired Realogic to implement RealmBudget for a 2,000 + tenant portfolio in a 30 day period.

  • Solution
    The process involved:
    • Mapping their subsidiary Chart of Accounts into their Corporate Chart of Accounts via Dynacode.
    • Overlay of multiple subsidiary Dyna files into their Corporate Standard Dyna files via Dynacode.
    • In addition, other critical import routines were conducted.

  • Impact/Results
    Allowed our client to:
    • Consolidate multiple divisions with differing chart of accounts.
    • Create single year budgets and multi-year forecasts in a single process.
    • Significantly reduce the budget cycle time frame.

Beware of the Demolition Clause

The dreaded "demolition clause" appears in many leases, especially in leases of older buildings or buildings that are located in areas within a city that are being turned around and renovated. Simply put, this clause states that the landlord can terminate the lease in order to sell or demolish the property.

Recourse: There's not really much you can do, even if you've completely renovated your space or only just moved in. The worst part - sometimes no reimbursement is made to the tenant, and quite often the notice of termination is very short, frequently ranging from 60 - 120 days.

What to do: Many experts recommend that you look for this clause during lease negotiation. It doesn't hurt to ask the landlord or owner to remove this clause. Sometimes this is a standard lease clause and it can be taken out of the lease. Another possibility is to ask for some type of compensation, either monetary or favorable leasing terms to new space in another building owned by your landlord.

Bottom Line: Be aware of this clause and the impact it can have on you as a tenant. Try to negotiate with the landlord for its removal or try to make it a little less stressful, should it ever come about.

Janna Thompson recently joined Realogic as Manager, Lease Abstracting Services. Her experience includes positions in lease administration for a grocery store wholesaler with a national portfolio of leased properties (retail, industrial and office), and in property management with developers in southern California.

Jill Rudolph joined Realogic as a Senior Consultant. Her experience in the real estate industry includes over 15 years at Metropolitan Structures, a real estate development company out of Chicago, Illinois in its leasing/legal department, which included preparing, administering and negotiating lease documents for approximately 6,000,000 square feet of office and retail space located in downtown Chicago. Jill graduated from Northern Illinois University with a BS in Social Work.

Farhan Madhani joined Realogic as Software Developer for Ellipsis Software. Farhan has been in the IT enterprise-solution environment for 4 years now, having worked at Headstrong, a niche IT consulting firm, as a Senior Analyst. His strengths lie in dynamic web-based development, specializing in both front end and back end work, while bringing a strong business approach.
